Terms of service

These terms apply to productized and custom development services provided by Develop It Today. A signed scope document takes precedence over this page where the two differ.
Scope
Every engagement is governed by a written scope document listing the deliverables, the fixed price, and the ship date. Work outside that document is a change order, priced and agreed in writing before it begins. Nothing outside the scope document is implied or assumed.
Payment
Fifty per cent is payable to reserve a build slot and begin work, and fifty per cent on completion before handover. Builds above $5,000 may be split into three instalments by agreement. Invoices are in USD and due on receipt.
On-time guarantee
If we miss the ship date stated in the scope document, the deposit is refunded in full. The date is measured in working days during which we are not blocked. Time spent waiting on your assets, access, approvals, or third-party sign-off pauses the clock, and we will notify you in writing when a pause begins.
Your responsibilities
You provide brand assets, account access, content, and approvals in a timely manner, and you confirm you have the right to use anything you supply. Delays in providing these move the ship date rather than triggering the guarantee.
Intellectual property
On final payment, all custom code and deliverables created for you transfer to you outright, including the source repository. We retain the right to reuse generic components, patterns, and know-how that are not specific to your business. Third-party libraries remain under their own licences.
Hosting and third-party services
Builds are deployed to accounts you own and control. You are responsible for subscription costs charged by those providers, including hosting, database, email, and AI model usage. We do not resell or mark up third-party services.
Support window
Each build includes thirty days of support after launch, covering defects in the delivered scope and minor adjustments. It does not cover new features, changes caused by third-party platform updates after handover, or issues arising from modifications made by others.
Confidentiality
We treat your business information, product plans, and data as confidential and will sign your NDA on request. We will not name you publicly as a client without your written permission.
Limitation of liability
Our total liability for any claim arising from an engagement is limited to the fees paid for that engagement. We are not liable for indirect or consequential loss, including lost profits or business interruption.
Cancellation
You may cancel before work begins for a full refund of the deposit. After work has begun, the deposit covers the work completed to that point and is non-refundable except under the on-time guarantee.
